Terms and Conditions

Please read these terms carefully before using our website, submitting an enquiry, enrolling in a program or participating in a Moko Sports session.

1. Agreement

These Terms and Conditions apply to your use of the Moko Sports website and participation in Moko Sports coaching programs, lessons, bookings, enrolments and related services.

By using our website, submitting an enquiry, enrolling in a program, making a booking or attending a lesson, you agree to these Terms and Conditions and any program-specific terms communicated to you.

2. Bookings and Enrolments

  • Bookings and enrolments are subject to availability, coach allocation, venue availability and suitability of the program for the participant.
  • For junior participants, a parent or guardian must provide accurate contact, medical, emergency and supervision-related information.
  • Moko Sports may recommend an assessment or change a participant's group to ensure appropriate placement by age, ability, safety and development needs.
  • We may decline, suspend or cancel a booking where information is incomplete, payment is outstanding, conduct is unsafe, or participation is not suitable for the program.

3. Fees and Payment

Fees must be paid by the due date advised by Moko Sports. A place in a class or lesson is not guaranteed until payment or payment arrangements are confirmed.

Prices may vary depending on program type, session length, term length, coach allocation, venue costs and operational requirements. Unless otherwise stated, prices are in Australian dollars.

4. Cancellations, Absences and Make-Up Sessions

  • Private lessons generally require at least 24 hours' notice to cancel or reschedule, unless otherwise agreed in writing.
  • Group programs, term programs and school programs follow the attendance and make-up rules communicated for that program.
  • Make-up sessions are subject to availability and are not guaranteed where notice is late, classes are full, the term has ended, or the absence falls outside the applicable make-up policy.
  • Failure to attend without required notice may result in the session being forfeited.

5. Refunds, Credits and Australian Consumer Law

Except where required by the Australian Consumer Law or other applicable law, fees paid are non-refundable for change of mind, personal scheduling conflicts, non-attendance, holidays or failure to provide required notice.

Where a refund, credit or make-up session is offered, it may be subject to reasonable conditions, expiry periods and administrative requirements.

Nothing in these Terms excludes, restricts or modifies any consumer guarantee, right or remedy that cannot lawfully be excluded under the Australian Consumer Law.

6. Weather, Venue and Program Changes

Tennis programs may be affected by weather, court conditions, venue restrictions, coach availability, enrolment numbers, public holidays or safety concerns.

Moko Sports may cancel, postpone, relocate, combine, reschedule or modify a session or program where reasonably necessary. We will take reasonable steps to communicate material changes.

7. Health, Safety and Medical Information

  • Participants must be medically and physically fit to participate in tennis activities.
  • You must notify us of relevant medical conditions, allergies, injuries, medication requirements or safety concerns before participation.
  • Participants must wear suitable sports clothing and footwear and bring water, sun protection and any personal equipment required.
  • Moko Sports may refuse participation where we reasonably consider there is a health or safety risk.

8. Assumption of Risk

Tennis and physical training involve inherent risks, including slips, falls, collision, impact from balls or racquets, muscle strain, heat exposure and other injuries.

To the extent permitted by law, you acknowledge these risks and agree that participation is at your own risk. For junior participants, the parent or guardian gives this acknowledgement on the child's behalf.

9. Conduct and Behaviour

  • Participants, parents and spectators must behave respectfully toward coaches, staff, players, parents, venue staff and other users.
  • Abusive language, unsafe behaviour, bullying, harassment, discrimination, repeated disruption, damage to property or failure to follow reasonable instructions may result in removal, suspension or cancellation without refund, subject to applicable law.
  • Parents and guardians are responsible for ensuring junior participants are collected on time and follow program rules.

10. Equipment and Property

Participants are responsible for their personal belongings. Moko Sports is not responsible for lost, stolen or damaged personal items except to the extent caused by our negligence or as required by law.

Any Moko Sports or venue equipment provided must be used safely and returned in reasonable condition. Damage caused by misuse or negligence may result in repair or replacement costs.

11. Photos, Videos and Marketing

From time to time, Moko Sports may take photos or videos for coaching, training, safety, administrative or promotional purposes. We will seek consent where required, particularly for identifiable images of children used for marketing.

If you do not want yourself or your child to appear in promotional material, please notify us in writing.

12. Website Use

  • You must not misuse the website, interfere with its operation, attempt unauthorised access, upload malicious code, scrape data, or use the website for unlawful purposes.
  • Website content, branding, text, images, graphics and materials are owned by or licensed to Moko Sports and must not be copied or reused without permission, except as permitted by law.
  • We may update, suspend or remove website content at any time without notice.

13. Third-Party Services and Links

Our website or communications may link to third-party websites, payment providers, maps, social media or embedded services. We are not responsible for third-party content, availability, security or privacy practices.

14. Limitation of Liability

To the maximum extent permitted by law, Moko Sports is not liable for indirect, incidental, special or consequential loss, loss of profit, loss of opportunity, or loss arising from events outside our reasonable control.

Where liability cannot be excluded, our liability is limited to the remedies available under applicable law, including the Australian Consumer Law.

15. Changes to These Terms

We may update these Terms and Conditions from time to time. The current version will be published on this page. Continued use of our services after changes are published indicates acceptance of the updated terms.

16. Governing Law

These Terms and Conditions are governed by the laws of Victoria, Australia. The parties submit to the courts of Victoria and any courts entitled to hear appeals from those courts.
